>>> GOOD AFTERNOON EVERYONE.

[Call the Work Session to Order]

[00:00:02]

WELCOME TO THE DECEMBER 9 WORK SESSION FOR THE CIP PROGRAM.

AND WE WILL START OFF BY, I WILL SEND IT TO DOCTOR HUTCHINGS TO START US OFF.

>> THANK YOU, MADAM CHAIR.

WE ARE HERE TO TALK ABOUT OUR CIP.

[1. FY 2022-2031 CIP Budget Add/Delete Work Session #1]

THIS IS OUR FIRST ADD DELETE SESSION.

I'M REALLY EXCITED ABOUT IT BECAUSE WE GET TO HAVE SOME CLEAR DISCUSSIONS AROUND OUR CIP FOR THIS YEAR.

I SAID THIS ONE HE FIRST INTRODUCED THIS TO THE BOARD THAT WE ARE ALL IN.

WE ARE GOING TO EXPERIENCE ECONOMIC DOWNTURN.

AND IT IS OUR RESPONSIBILITY TO MAKE SURE WE ARE BEING PHYSICALLY RESPONSIBLE AS STEWARDS OF CITY FUNDS AND ALL OUR TAXPAYER DOLLARS AS WELL AS FEDERAL DOLLARS AND STATE DOLLARS IN GRANTS AND THINGS.

AND I AM HOPING AS WE TALKED THROUGH TODAY, WE CONTINUOUSLY KEEP THAT IN MIND.

AND THAT I AM HOPING OUR TEAM WILL BE ABLE TO PROVIDE CLARITY AROUND SPECIFICALLY WITH THE FY 22 CIP YEAR.

BUT THROUGHOUT THE WHOLE 10 YEAR SPAN THAT WE WILL BE ABLE TO BRING CLARITY TO BOARD MEMBERS.

AND FINALLY, I WANT TO STATE THIS AND I THINK IT IS IMPORTANT FOR US TO REMIND THE COMMUNITY THAT THE ONE THING ABOUT THE 10 YEAR PLAN IS WE DON'T HAVE A CRYSTAL BALL TO SEE WHAT THINGS LOOK LIKE WELL INTO THE FUTURE, BUT GOOD PLANNING IS A GOOD START GORGON AND IT DOESN'T MAKE A DEFINITIVE, IT DOESN'T MAKE IT TO BE THIS WAY.

WITH HOW THINGS HAVE CHANGED OVER THE PAST COUPLE OF YEARS.

A LOT CAN HAPPEN IN A SHORT PERIOD OF TIME AND I THINK IT IS IMPORTANT FOR US TO MAKE SURE WE ARE REMINDING OUR COMMUNITY THAT OUR CIP, BECAUSE IT IS A 10 YEAR SPAN, IT IS PROJECTION.

IT IS PLANNING.

IT IS NOT A DEFINITIVE DOCUMENT FORGET ESPECIALLY WHEN YOU GET INTO FIVE, SIX, SEVEN, EIGHT, NINE, 10 YEARS OUT THINGS CAN HAPPEN AND WE DON'T HAVE THE MAGIC BALL TO LOOK AT.

AND WILL TURN THINGS OVER TO ERICA JUST TO TALK A LITTLE BIT ABOUT SOME OF OUR CIP GOALS THAT WE SET FROM THE BOARDS PRIORITIES.

IN ANY COMMENTS SHE WOULD LIKE TO MAKE ON BEHALF OF HER TEAM OR FACILITIES IN OPERATIONS BEFORE WE GET INTO OUR Q&A.

>> THANKS DOCTOR HUTCHINGS AND GOOD AFTERNOON BOARD MEMBERS.

MS. NIELSEN, IF YOU COULD PUT UP THE ADD DELETE COSPONSOR STRIP FORM.

AS DOCTOR HUTCHINGS SAID, JUST WANTED TO TALK ABOUT WHAT WE WERE TRYING TO ACCOMPLISH WITH THE CIP AND WHY IT IS STRUCTURED AND THE WAY IT IS.

WE ONLY HAD FOUR ADD DELETE THIS YEAR SO IT SEEMS LIKE WE WERE ABLE TO ALIGN WITH THE SCHOOL BOARDS PRIORITIES.

WE ARE HAPPY ABOUT THAT.

AND JUST WALKING THROUGH THE FOUR ADD DELETES WE RECEIVED.

THE FIRST BEING A REQUEST TO ACCELERATE $10 MILLION WORTH OF THE â€" SORRY.

>> SORRY, I DIDN'T MEAN TO DO THAT TO YOU.

>> NO, THAT IS OKAY.

I THINK THAT IS FINE.

PEOPLE ARE ABLE TO READ IT.

BUT BASICALLY THE FIRST TO ADD DELETES WE RECEIVED WERE TO ACCELERATE FUNDING TO SUPPORT SWING SPACE AND PROPERTY ACQUISITION POTENTIALLY RELATED TO THAT SWING SPACE FROM THE NEW SCHOOL FUNDING THAT WAS FURTHER ON IN THE OUT YEARS.

WE DO WANT TO NOTE THAT IN THE INITIAL ONE WE PUT IN THE STAFF COMMENTS THAT IT WOULDN'T ALLOW FOR US TO FULLY FUND THAT NEW SCHOOL FURTHER OUT IN THE CIP.

AND ADDITIONALLY, THE $10 MILLION ALONE MAY NOT BE SUFFICIENT TO PROVIDE FOR A SWING SPACE.

BUT WE DO UNDERSTAND AND RECOGNIZE THE NEED TO HAVE THAT DISCUSSION AND IS SWING SPACE IS GOING TO BE REQUIRED, WHAT ARE THE OPTIONS THAT WE HAVE.

THE SECOND ADD DELETE BEEN MOVING 30 MILLION FROM FY 2031, ORIGINALLY FOR THE NEW SCHOOL TO FY 2022 TO SET ASIDE FOR PROPERTY ACQUISITIONS.

I WOULD NOTE THAT IN THE FY 2019 CIP, WHICH WAS THE TASK FORCE, THE CIP THAT CAME OUT

[00:05:01]

AFTER THE TASK FORCE, THE SCHOOL BOARD DID REQUEST $30 MILLION IN PROPERTY ACQUISITION FUNDS.

THE CITY HELD ONLY 40 OR $45 MILLION IN PROPERTY ACQUISITION FUNDS IN RESERVE BOND CAPACITY IN THAT FISCAL YEAR.

FROM THAT TIME, THE SCHOOL BOARD APPROVED THEIR BUDGET WITH THE 30 MILLION.

IT WAS NOT PROVIDED AS DIRECT FUNDING BUT INDIRECT IN RESERVE BOND CAPACITY IN AN EVENT AN OPPORTUNITY PRESENTS ITSELF IN THE FUTURE.

WE WANT TO MAKE SURE THE SCHOOL BOARD WAS AWARE YOU SHOULD STILL HAVE 28 1/2 MILLION APPROXIMATELY LEFT IN THAT RESERVE BOND CAPACITY SHOULD A PROPERTY OPPORTUNITY PRESENTED ITSELF.

AND IN THE LAST TWO ADD DELETES SUBMITTED HAD TO DO WITH CHANGING THE PROJECT NAME FOR THE NEW SCHOOL TO A NEW MIDDLE SCHOOL AND ADDRESSING THE MIDDLE SCHOOL NEED TO, WHICH IN PREVIOUSLY CIP SCHOOL BOARD AND COMMUNITY MAY BE FELT WAS AND NOT ADDRESSED DIRECTLY.

I THINK AS DOCTOR HUTCHINGS STATED, BECAUSE IT IS IN THE OUT YEARS OF THE CIP, WE STILL HAVE A LOT OF WORK TO DO IN PLANNING RUN WITH THE PROJECT IS AND WHAT THE GRADE LEVEL CONFIGURATION FOR THAT PROJECT WILL BE.

AND SO YOU HAVE OUR STAFF NOTES THERE.

DOCTOR HUTCHINGS, NOT SURE IF YOU WANT ME TO TURN IT BACK TO YOU OR IF CHAIR ANDERSON WILL FACILITATE THE CONVERSATION.

>> I WOULD ASK FOR CHAIR ANDERSON.

DO YOU WANT US TO FACILITATE THE CONVERSATION IN TALKING ABOUT EACH OF THESE? HOW WOULD YOU LIKE TO FACILITATE THIS DISCUSSION?

>> I SINCE THINK SINCE THERE ARE FOUR OF THEM, I THINK I WOULD ASK IF YOU HAVE ANY ADDITIONAL â€" AND WE HAVE HAD ADDITIONAL CLARITY.

AND ASK IF ANYBODY HAS ANY COMMENTS OR ADDITIONAL QUESTIONS ABOUT ANY OF THE FOUR SINCE THERE ARE JUST FOUR.

NOW SOMEHOW I AM NOT SEEING â€" LET'S SEE.

MS. ALDERTON?

>> THANK YOU MADAM CHAIR.

I JUST WANTED TO STATE MY PURPOSE FOR FOR COSPONSORING MS. THORTON ADD DELETE, WHICH WAS ITEM NUMBER FOUR.

AND REALLY JUST TO MAKE SURE, I THINK IS AN OPPORTUNITY THE COMMUNITY HEARS THERE IS A CONVERSATION IN TERMS OF THINKING ABOUT MIDDLE SCHOOL.

I DON'T IMAGINE SOMETHING, ESPECIALLY SOME OF THE IDEAS THAT COULD POTENTIALLY HAPPEN WOULD BE SOMETHING THAT GO IN THE CIP.

JUST KEEP NOT TOP OF MIND I THINK IS IMPORTANT THAT PEOPLE KNOW WE ARE THINKING ABOUT THAT.

SO I JUST APPRECIATED MS. THORTON PUTTING THAT IN THEIR TO HIGHLIGHT IT FOR THE PUBLIC.

THAT IT IS BEING THOUGHT ABOUT GORGON AND WHATEVER WE CAN DO TO CONTINUE TO HIGHLIGHT THAT IS AN IMPORTANT PART OF THE DISCUSSION FOR OUR FUTURE THAT I THINK WILL BE GOOD FOR US.

THANK YOU.

>> MADAM CHAIR, I WANTED TO MENTION WITH THE RULES OF ENGAGEMENT OF THE TWO OR MORE COSPONSORS I THINK ARE SUPPOSED TO GO FIRST IN THE DISCUSSION AND THEN THE OTHERS.

>> SO RIGHT YOU ARE.

LIKELY, MS. ALDERTON DID THAT REALLY SHE KEPT ME FROM MAKING A PHONE CALL IN OUR ENGAGEMENT.

SO THANK YOU MS. ALDERTON.

AND SO NOW WE HAVE â€" I GUESS IS THERE ANYONE ELSE WHO WANTS TO TALK ABOUT THAT PARTICULAR ITEM BEFORE WE GO ON TO THE ONES WITH FEWER? IS THORTON?

>> THANK YOU MADAM CHAIR.

GOING OFF WHAT MS. ALDERTON SAID, I KNOW DOCTOR REESE AND I HAD SIMILAR COMMENTS ON THIS PARTICULAR TOPIC.

AND ESSENTIALLY IT IS THE FACT WE WANT TO MAKE SURE THIS CONVERSATION REGARDING MIDDLE SCHOOL CAPACITY IS BEING PUBLICLY DISCUSSED FOR THE COMMUNITY.

I KNOW WE ARE CONSTANTLY AS A GROUP THINKING ABOUT CAPACITY IN ALL FACETS.

AND SECONDARY CAPACITY WE TEND TO GROUP TOGETHER.

BUT MIDDLE SCHOOL LEVEL IS A LITTLE DISTINCT, ESPECIALLY IN THE MIND OF COMMUNITY MEMBERS.

SO SOMEWHERE SOMEHOW IT IS IMPORTANT WE INDICATE WHAT OUR THOUGHT PROCESS IS ON THAT FRONT.

THAT'S WHY I KIND OF INDICATED AS A QUESTION OR A COMMENT, I KNOW THERE ARE PLANS, BUT WE WOULD BE THE BEST PLACE TO INDICATE THAT SO IT IS CLEAR TO PEOPLE.

AND IT MAY NOT BE IN THE CIP, BUT I WELCOME STAFFS IDEAS OR THOUGHTS ON THAT AND WHERE IT COULD BE.

THANKS.

>> OKAY.

ANYBODY ELSE FOR THAT ABOUT RENAMING THE SITE? OKAY.

[00:10:01]

DOCTOR, YOU ALSO SAID SOMETHING ABOUT THIS SO YOU WERE NEXT.

>> THANK YOU.

I WANT TO ECHO THE COMMENTS I HAVE ALREADY HEARD.

LOOKING AT â€" NO TW MIDDLE SCHOOL IN PARTICULAR.

THE CAPACITY AND THE SCHOOL IS 1150 STUDENTS HERE RIGHT NOW 1561 STUDENTS ENROLLED.

THAT IS EVEN DURING THE PANDEMIC.

SO EVEN THOUGH WE SAW A LITTLE BIT OF A DECREASE, WE ARE STILL SIGNIFICANTLY OVER CAPACITY IN THAT PARTICULAR SCHOOL WRITTEN HAMMOND IS ALWAYS AT FULL CAPACITY.

SO EVEN IF THIS NEW SCHOOL TURNS INTO A MIDDLE SCHOOL, THAT'S GOING TO BE 10 YEARS DOWN THE LINE BEFORE IT MATERIALIZES.

SO I HAD ASKED THE QUESTION WITH THE BUDGET QUESTIONS ABOUT WHAT INFORMATION DO WE NEED TO MAKE THE DECISION ON WHETHER THAT WILL BE IN MIDDLE SCHOOL.

IT WAS SAID THAT STAFF NEEDS TO CONDUCT ANALYSIS AND FEASIBILITY STUDY.

SO WAS JUST WONDERING WHAT, IF YOU COULD JUST TALK ABOUT THE TIMELINE IS FOR THAT.

BECAUSE I KNOW THIS NEW SCHOOL HAS BEEN IN THE BUDGET FOR A LONG TIME.

YOU KNOW WE DID THE DAY SCHOOL, BUT IT CONTINUES TO GET PUSHED BACK.

AND SO JUST TRYING TO UNDERSTAND WHAT DO WE NEED AND WHAT ARE WE GOING TO MAKE IT HAPPENED TO DETERMINE WHETHER THIS WILL BE A MIDDLE SCHOOL OR WHAT THE MIDDLE SCHOOL SOLUTION IS GOING TO BE.

>> WE WILL BE ABLE TO COME BACK TO THE BOARD WITH MORE OF A TIMELINE, I WOULD SAY IN FEBRUARY OR MARCH TIMEFRAME.

WE REALLY ARE TRYING TO FOCUS SO MUCH NOW ON THE HIGH SCHOOL PROJECT.

TRYING TO GET DOUGLAS MACARTHUR COMPLETED.

WE STILL HAVE THE SAME NUMBER OF STAFF NUMBERS.

WILL BE DIFFICULT FOR US, FOR ME TO ADD THAT TO THE STAFFS LIST OF THINGS TO DO RIGHT NOW.

BUT IT IS SOMETHING WE CAN DEFINITELY COME BACK TO YOU IN FEBRUARY OR MARCH TIMEFRAME TO SHARE WHAT TIME WHEN WE ARE LOOKING AT.

BUT THERE ARE MULTIPLE THINGS WE WILL HAVE TO INVESTIGATE BEYOND JUST THE MIDDLE SCHOOL.

JUST LOOKING AT ALL OUR ENROLLMENT PROJECTIONS.

ESPECIALLY THROUGH THIS COVID-19 WORLD.

AND HOW THAT IS IMPACTING ALL OF OUR SCHOOLS IS GOING TO BE A MAJOR CONCERN AND SOMETHING WE WILL BE INVESTIGATING THIS SPRING.

AND I THINK WILL GO WELL INTO THE FALL OF NEXT YEAR.

BUT I THINK THAT WILL BE AN OPPORTUNE TIME FOR US TO START REVISITING SOME OF THE CONVERSATIONS AROUND CAPACITY AT THE MIDDLE SCHOOL LEVEL.

SPECIFICALLY.

>> I WOULD SAY THE NEW SCHOOL IS SEPARATE FROM THE LAND ACQUISITION MONEY, RIGHT.

SO THERE IS ALWAYS THAT TO THINK ABOUT.

AND WHAT WE DID, THAT WAS LAND AND A BUILDING.

THERE ARE THINGS OUT THERE.

I DO THINK WE WERE GOING TO HAVE SOME DISCUSSIONS ABOUT THIS IF WE HASN'T SHUT DOWN IN MARCH.

I REMEMBER THERE WAS SOMETHING ON THE MEETING AGENDA THAT I DON'T KNOW ANYTHING ABOUT, BUT I KNEW IT WOULD BE SOMETHING ABOUT THIS KIND OF DISCUSSION.

I THINK IT WAS MAYBE MARCH WHEN IT WAS SUPPOSED TO BE HAPPENING.

AND THEN AND DIDN'T HAPPEN.

I KNOW PEOPLE ARE THINKING ABOUT IT.

SO WE JUST HAVE TO KEEP â€" NOW WITH THE WAY ECONOMIC CONDITIONS, WE NEED TO KEEP OUR EYES OPEN FOR THINGS.

RIGHT.

SO IF THERE IS ANYBODY ELSE ABOUT ANY OF THE OTHERS, I THINK WE HAVE GOTTEN EVERYBODY FOR THAT RENAMING.

DOCTOR REESE?

>> OKAY.

THANK YOU.

ONE OF THE QUESTIONS I HAD ASKED ABOUT â€" YOU MENTIONED LOOKING AT THE ENROLLMENT DATA.

AND I HAD ASKED ABOUT ONE OF THE BUDGET QUESTIONS WAS ABOUT A POTOMAC YARD DEVELOPMENT AND HOW MANY STUDENTS WERE COMING OUT OF THE NEW DEVELOPMENT THAT HAS BEEN HAPPENING IN THAT AREA.

AND THE ANSWER WAS THAT IT WAS GOING TO BE SHARED WITH THE BOARD IN ADVANCE OF THE BUDGET ADOPTION, THE CIP BUDGET ADOPTION.

BUT I KNOW YOU WILL HAVE A LOT GOING ON.

MAYBE THAT WILL BE A LITTLE BIT LATER.

BUT I WANTED TO UNDERSTAND ABOUT THAT TIMELINE.

BUT SPEAKING TO THE OTHER ITEMS I SUBMITTED, I THINK MY CONCERN THAT I WAS GETTING AT WAS WITH ALL OF THESE ADS IS THAT LOOKING AT OUR CIP BUDGET OVER THE

[00:15:03]

YEARS, I MENTIONED THIS BEFORE THAT IT IS HARD EVERY YEAR WE GET THE 10 YEAR PLAN AND WE DON'T REALLY SEE THE HISTORY AND HOW THINGS HAVE EVOLVED.

IT IS INTERESTING WHEN YOU GO BACK AND LOOK BECAUSE YOU SEE HOW THERE IS A HISTORY OF PROJECTS ALWAYS GETTING DELAYED, DELAYED, PUSHED BACK, PUSHED BACK.

KNOWING WE HAVE HAD THIS NARRATIVE THAT WE HAVEN'T INVESTED ENOUGH IN OUR SCHOOL BUILDINGS AND WE HAVEN'T MODERNIZED AND BUILT NEW SCHOOLS AS WE HAVE NEEDED TO.

SO JUST TRYING TO THINK AHEAD AND HOW TO KEEP THESE PROJECTS ON SCHEDULE.

SO ONE PROJECT I AM PARTICULARLY CONCERNED ABOUT IS THE GEORGE MASON PROJECT.

IN TERMS OF WHAT IS GOING TO HAPPEN WITH THE KIDS WHEN THE BUILDING IS BEING CONSTRUCTED.

AND WANTED TO HAVE AN UNDERSTANDING OF THE OPTIONS WE ARE LOOKING AT.

AND SO MY UNDERSTANDING IS WE ARE GOING TO GET THE FEASIBILITY STUDY IN THE SPRING.

IT WOULD BE COMPLETED ABOUT THAT SPACE.

AND IT DOES SEEM IT CAN BE FEASIBLE TO BUILD ON SITE THERE.

AND THEN ANOTHER POSSIBILITY IS THE MANY HOWARD BUILDING BEING A SWING SPACE.

OR THE THIRD POSSIBILITY WOULD BE FINDING SWING SPACE ELSEWHERE.

EACH OF THOSE OPTIONS HAS A DIFFERENT TIMELINE.

WE CAN'T START THE PROJECT UNTIL WE HAVE A PLACE FOR THE KIDS TO GO.

SO IF IT DOES TURN OUT WE WOULD NEED A SWING SPACE SOMEWHERE ELSE, IT WOULD SEEM TO ME LIKE NO WE WOULD HAVE TO BE WORKING ON THAT IN ORDER TO STAY ON THE CURRENT TIMELINE FOR THIS PROJECT.

SO I AM PUSHING US TO GET SOME CLARITY AROUND WHEN THAT DECISION IS GOING TO BE MADE.

HOW MUCH TIME DO WE HAVE TO NOT MAKE THIS DECISION OR HOW MIGHT IT IMPACT THE TIMELINE IF WE DON'T MAKE THE DECISION SOONER.

I DON'T KNOW IF YOU HAVE ANY THOUGHTS ON THAT.

I'M GLAD TO UNDERSTAND THE 28.5 MILLION IS STILL AVAILABLE IN THE CITIES BUDGET.

BUT I AM ALSO JUST WONDERING, WE HAD A CONVERSATION WITH COUNSEL ABOUT HOW THIS WOULD BE AN OPPORTUNE TIME TO PURCHASE PROPERTY.

BECAUSE THERE MIGHT BE MORE PROPERTY AVAILABLE AT A LOWER COST RIGHT NOW.

I WOULD LIKE TO UNDERSTAND IF THAT IS WORTH TAKING TO POTENTIALLY DO THAT SO THAT WE DON'T MISS THIS OPPORTUNITY.

SO IF YOU COULD TALK ABOUT THOSE TWO THINGS, I WOULD APPRECIATE THAT.

>> THANK YOU FOR THAT QUESTION.

ONE THING I WANT TO MAKE CLEAR IS WHEN WE WERE LOOKING FOR LAND OPTIONS FOR THE HIGH SCHOOL PROJECT WE WERE WORKING WITH THE REAL ESTATE ATTORNEY, WE WERE ALSO LOOKING AT POTENTIAL OPTIONS FOR ALL OUR FUTURE PROJECTS AS WELL AT THAT TIME.

DURING THAT TIME THERE WERE NOT A LOT OF PLACES EVEN FOR ELEMENTARY SCHOOLS.

AND WE SHARED THAT WITH THE BOARD.

NOW THAT I WAS HAPPY TO HEAR THE CITY TALK ABOUT ALL THESE PARTICULAR POTENTIAL LOCATIONS THAT WE COULD PUT A SCHOOL AT IN SOME POINT IN THE FUTURE.

AND THAT DOES GIVE US SOME HOPE IN LOOKING FOR SOME POTENTIAL SWING SPACE OR POTENTIAL NEW SCHOOL SPACE THAT WE COULD ACQUIRE LAND OR BUILDINGS WITH THIS NEW WAVE OF REAL ESTATE THAT MIGHT BE OUT THERE.

BUT THAT WASN'T THE CASE.

WE HAVE BEEN LOOKING FOR LAND EVERY YEAR SINCE I HAVE BEEN HERE I KNOW FOR SURE.

AND IT JUST HASN'T BEEN AVAILABLE.

THIS MAY OPEN SOME DOORS FOR US SO WE CAN BRING SOME POTENTIAL SITES MOVING FORWARD.

BUT WE ARE CONSTANTLY LOOKING AT POTENTIAL LAND OPPORTUNITIES AND BUILDING OPPORTUNITIES.

I WANTED TO MAKE THAT CLEAR TO THE COMMUNITY.

SO THAT WAS TO ANSWER YOUR SECOND QUESTION.

WAS THE FIRST QUESTION YOU ASKED.

>> ASKED ABOUT ENROLLMENT IN THE GEORGE MASON PROJECT.

BECAUSE ANOTHER POINT I WANTED TO MAKE WAS IF WE ARE LOOKING UP BUILDING ON SITE AT GEORGE MASON ADJACENT TO THE BUILDING EXISTING, OR IF WE ARE LOOKING AT USING MANY HOWARD IS A SWING SPACE, I THINK THE SOONER WE CAN START ENGAGING THE COMMUNITY AROUND THOSE ISSUES WOULD BE CRITICAL.

BECAUSE IT IS NEVER FUN WHEN THE COMMUNITY FINDS OUT LATE IN THE PROCESS ABOUT A DECISION THAT HAS BEEN MADE.

SO THE ENROLLMENT UPDATE AND THEN THE POTOMAC YARD.

AND THEN THE GEORGE MASON PROJECT.

[00:20:01]

>> THE POTOMAC YARD, WE ARE STILL KIND OF WORKING ON SOME OF THE LOGISTICS IN REGARDS TO THE PROJECT.

THAT IS DEALING WITH VIRGINIA TECH, IT IS DEALING WITH THE CITY.

AMAZON.

THERE IS A LOT GOING ON WITH THAT PARTICULAR SITE.

WE ARE STILL WORKING THROUGH LOGISTICS AROUND THAT.

BUT WITH THE GEORGE MASON ELEMENTARY PROJECT, AND PROVIDES MORE INSIGHT.

WE DID START THAT CONVERSATION LAST YEAR WHEN WE BEGAN DOING THE FEASIBILITY STUDY AT GEORGE MASON AND TRYING TO GET THAT PROCESS STARTED.

AND THEN OF COURSE WE WENT INTO OUR GLOBAL PANDEMIC THAT WE ARE IN RIGHT NOW.

BUT MISS GOOD LUCK AND TALK TO, IN REGARDS TO THE PROCESS AND HOW IT WORKS FROM THE TIME WE NOW KNOW WHEN WE ARE PLANNING TO OPEN A NEW BUILDING AND HOW WE WORK BACKWARDS FROM THAT.

AND WHAT IS THAT TIMEFRAME OF IDENTIFYING THE PARTICULAR SWING SPACE AND GETTING INTO A PRE-DESIGN PHASE, GETTING INTO THE DESIGN PHASE AND THINGS OF THAT NATURE.

IF HE COULD TALK TO THAT, WE WOULD GREATLY APPRECIATE IT.

>> SURE.

I WANT TO TOUCH ON BECAUSE I KNOW, I DO RECALL A QUESTION ABOUT POTOMAC YARD ENROLLMENT AND WE ARE WORKING ON THAT.

IN NOVEMBER WE GOT ALL THE STUDENTS, WE MET THEM, WE MAKE SURE THEY ARE IN THE PLACE WE WILL PROVIDE A BRIEF ON THAT SOON IN THE COMING WEEKS ABOUT HOW MANY STUDENTS ARE THERE.

I WOULD NOTE THE MAJOR RESIDENTIAL DEVELOPMENT HASN'T HAPPENED YET SO IT'LL BE INTERESTING TO SEE WHAT HAPPENS WHEN THAT COMES ONLINE.

REGARDING GEORGE MASON SWING SPACE OPPORTUNITIES WERE NOT USING SWING SPACE, WHEN THE PANDEMIC KIT AND SOME OF THE OTHER PROJECTS WE HAVE GOING ON, WE KIND OF PUT THE FEASIBILITY STUDIES ON HOLD.

WE ARE INTENDING TO PICK THEM BACK UP IN THIS UPCOMING CALENDAR YEAR IN JANUARY AND HOPING TO HAVE SOME COMMUNITY DISCUSSIONS ON THIS.

THE SWING SPACE TIMELINE DEPENDS ON WHAT YOU DO.

YOU BROUGHT UP MANY HOWARD.

IF WE DID SOMETHING LIKE THAT, WE GOT THE SWING SPACE APPROVALS AND MOST OF THE CONSTRUCTION WORK DONE FOR PATRICK HENRY TO USE THAT FOR MACARTHUR WITHIN A YEAR.

AND SO WITH CONSTRUCTION FUNDING BEING THREE YEARS OUT STILL FOR MANY HOWARD, THAT WOULD EVEN ALLOW US TO IF WE DID FIND A POTENTIAL LAND OPPORTUNITY, TO BUY AND RENOVATE WITHIN THAT TIMEFRAME.

I AGREE WITH YOU AND I THINK WE ALL AGREE THOSE ARE DECISIONS THAT NEED TO BE MADE AND HOPING WE HAVE A SIGNIFICANT CONVERSATION ABOUT THAT IN THE SPRING IN CONJUNCTION WITH THOSE STUDIES.

>> IF I COULD MAKE ONE QUICK FOLLOW-UP TOO.

I REMEMBER CHAIR ANDERSON BRINGING THIS UP LAST YEAR.

WHEN YOU LOOK AT THE SUMMARY FOR THE CIP, IT HELPS WHEN YOU HAVE THAT OPEN, YOU INDICATE WHEN THE OPENING WOULD BE BECAUSE YOU KNOW THERE IS A LAG TIME.

THERE IS THE DESIGN FUNDING AND IT IS TWO YEARS LATER WHEN IT OPENS.

IN MY HEAD I WAS TRYING TO FIGURE OUT IF I SCHOOL PROJECT IF IT OPENS IN FALL OF 2024, WOULD THAT BE TIME TO GET THE GEORGE MASON COMMIT TO USE THAT AS A SWING SPACE BASED ON THE TIMELINE.

I THINK ADDING THAT INTO THE CIP SUMMARY IS SUPER HELPFUL.

>> THANK YOU.

I WAS JUST SITTING HERE THINKING THAT.

I HAD ACTUALLY FORGOTTEN I ASKED THAT BEFORE.

WAS TRYING TO COUNT UP WHEN THE OPEN THINGS SHOULD BE IN MY HEAD.

THAT IS HELPFUL WHEN YOU DON'T HAVE TO KEEP TRACK OF IT AND YOU JUST SEE IT AS A SQUARE.

SO THANK YOU.

ANYONE ELSE WITH ANYTHING ELSE? OKAY.

I DON'T SEE ANY HANDS.

IS THAT ALL WE HAVE ON THIS WORK SESSION? THE WE HAVE A MEETING AFTERWARDS.

MS. NIELSEN, DOES MS. NOLAN HAVE THE LANGUAGE FOR THAT MEETING?

>> YES.

BUT I BELIEVE WE ALSO HAVE SOME POLICIES.

>> I THOUGHT WE WERE SUPPOSED TO HAVE POLICIES, BUT ARE THEY ON HERE? OR IS THAT PART OF THE MEETING?

>> POLICIES ARE A PART OF THE WORK SESSION.

THAT IS THE NEXT AGENDA ITEM.

>> YOU KNOW WHAT, I AM SO SORRY.

WE TALKED ABOUT THIS FOR QUITE A BIT.

AND I WAS THINKING MORE OF THE POLICIES WHY DID I NOT SEE THEM.

TO GO ANYWHERE YET, WE HAVE POLICIES.

WINDOW TURNED OVER.

>> THANK YOU SO MUCH CHAIR ANDERSON.

>> I AM SO SORRY, IS IT'S STILL NECESSARY, COULD DOCTOR HUTCHINGS OR DO WE

[00:25:06]

STILL NEED TO FORMALLY CLOSE OUT THE AD DELETE PROCESS AND DETERMINE WE DON'T NEED ANOTHER UNDELETE?

>> YES.

THANK YOU.

WHAT WOULD WE DO WITHOUT EVERYBODY.

THANK YOU FOR THE PROCESS POINTS.

WE ONLY HAD THREE PEOPLE AT THE ONE THING.

I MADE AN ASSUMPTION, WHICH I SHOULDN'T DO.

AND I CAN'T SEE EVERYBODY WITH THE THUMBS UP AND THUMBS DOWN.

SO I WOULD SAY YOU ARE THINKING WE NEED A SECOND AD DELETE SESSION, IF YOU WOULD RAISE YOUR HAND ON THE ELECTRONIC HAND NOW.

BECAUSE I CAN'T SEE EVERYBODY'S HAND ALL THE TIME.

THERE ARE TWO PAGES.

BECAUSE WE WERE THINKING WE DIDN'T NEED ONE AND WE HAVE TALKED THROUGH THESE ISSUES.

I DON'T SEE ANYBODY'S HAND BUT THANK YOU.

WE DID NEED TO MAKE THAT BECAUSE MR. TURNER WOULD BE WONDERING DO I HAVE ANOTHER MEETING CERTAIN OR NOT.

I DON'T THINK WE NEED THE SECOND WORK SESSION.

I AM REALLY OFF OF MY GAME HERE.

MR. TURNER?

>> I JUST WANTED TO CONFIRM THE AD.

I WANT TO BE CLEAR IF WE ARE CHANGING THE PROJECT NAME TO MIDDLE SCHOOL OR IF WE ARE GOING TO LEAVE IT AS NEW SCHOOL.

JUST SO WE KNOW AS WE ARE MOVING THE DOCUMENTS FORWARD.

>> I SAW THERE WERE THREE PEOPLE â€" I GUESS FOR PEOPLE MAY BE BECAUSE â€" NO, THREE PEOPLE.

THERE WERE THREE PEOPLE.

WERE THERE ANY ADDITIONAL PEOPLE FOR THE CHANGING THE NAME? IF YOU COULD RAISE YOUR HAND ON THE SCREEN.

IS NOT A VOTE BECAUSE IT'S A WORK SESSION, I CAN'T SEE EVERYBODY'S HAND SO THIS WILL JUST MAKE IT EASIER IF THERE ARE ADDITIONAL PEOPLE.

OKAY.

I DON'T SEE ANY.

I THINK WE ARE GOOD THANK YOU.

I NEVER DO THIS UP AND DOWN THING VERY WELL ANYWAY.

I GET RATHER CONFUSED ABOUT THAT.

ALL RIGHT.

WITHOUT FURTHER ADO, WE HAVE BEEN WAITING, WE'VE BEEN PUSHING POLICY OFF FOR SOME

[2. Revisions to G, C & K (Personnel and Law Enforcement-Related) Policies and Regulations]

TIME.

SO WE ARE EAGERLY AWAITING WHAT YOU HAVE TO SAY TO US.

>> THANK YOU CHAIR ANDERSON.

GOOD EVENING BOARD.

WE ARE GOING TO REVIEW 10 PERSONNEL RELATED POLICIES THIS EVENING.

OR I SHOULD SAY EIGHT TECHNICALLY AND THEN WE HAVE TWO RELATED TO LAW ENFORCEMENT.

BUT WE ARE GOING TO START DOING REGARDING POLICIES AND PRESENTING TO THE BOARD BECAUSE THE MEETINGS ARE SO FULL THIS YEAR, THERE'S SO MUCH GOING ON.

YOU ARE GOING TO START GETTING ABOUT 10 POLICIES PER WORK SESSION.

EVERY WORK SESSION.

AND SO JUST SMALL BITES AND WE CAN GET THROUGH THE WORK.

AND SO FOR THIS EVENING WE ARE GOING TO START THE FIRST POLICY IS GAAP, THIS IS TELEWORK.

THE CHANGES YOU WILL SEE BASICALLY WITHIN THE REGULATION, WHICH FOLLOWS ON THE NEXT PAGE ARE THAT WE HAVE TRIED TO DISTINGUISH BETWEEN INDIVIDUAL TELEWORK REQUESTS AND MASS TELEWORK EVENTS.

IN RECOGNITION OF OUR NEW REALITY, THE NEW STATE OF THE WORKFORCE SO MANY PEOPLE ARE TELEWORKING.

AND DURING THESE PUBLIC HEALTH EVENTS, THE BULK OF OUR WORKFORCE IS TELEWORKING AT THE MOMENT.

WE RECOGNIZE OUR TELEWORK POLICY AND REGULATION REALLY ONLY ADDRESSED CIRCUMSTANCES PRIOR TO THE PANDEMIC WHERE IT WAS A LIMITED CIRCUMSTANCE WHERE AN INDIVIDUAL COULD REQUEST TELEWORK.

SO REALLY IF WE JUST SCROLL THROUGH THE REGULATION WITH THE CHANGES ARE ATTEMPTING TO DO IS JUST DISTINGUISH BETWEEN INDIVIDUAL TELEWORK REQUEST UNIQUE CIRCUMSTANCES AND WHEN I HAVE MASS TELEWORK EVENTS, ADDING DEFINITIONS TO DISTINGUISH BETWEEN THE TWO AND CLEANING UP THE FORMS AT THE END OF THE REGULATION THE FIRST ATTACHMENT WAS A REQUEST FORM THAT IN THE PAST DID NOT DISTINGUISH BETWEEN THE TWO TYPES OF TELEWORK.

IT IS NOW REVISED TO DISTINGUISH THE FACT THAT YOU ONLY HAVE TO SUBMIT A FORM TO REQUEST TELEWORK IN ADVANCE WHEN IT IS A UNIQUE CIRCUMSTANCE AN INDIVIDUAL REQUEST WHEN THE BULK OF THE WORK PORT FORCE IS IN PERSON.

AND THEN THE SECOND ATTACHMENT IS A TELEWORK AGREEMENT REDRAFTED FOR ALL

[00:30:06]

PERSONNEL WHO ARE TELEWORKING SO EVERYONE IS ON THE SAME PAGE AND THE EXPECTATIONS ARE CLEAR AS TO WHAT IS INVOLVED IN REMOTE WORK.

AND BECAUSE WE HAVE SO FEW POLICIES THIS EVENING, UNLESS YOU DISAGREE, I SUGGEST WE DO QUESTIONS AT THE END OF ALL OF THEM.

DOES THAT WORK.

>>CINDY ANDERSON: THAT WORKS FOR ME.

THANKS.

>> WE WILL MOVE ON TO THE NEXT ONE, WHICH IS POLICY GBD CROSS-REFERENCED SBG.

THIS IS FORMALLY CALLED BOARD STAFF COMMUNICATIONS AND HAS BEEN RETITLED EMPLOYEE FEEDBACK PROTOCOL AND COMMUNICATIONS WITH THE SCHOOL BOARD.

THIS IS A POLICY THAT WILL LOOK FAMILIAR TO YOU BECAUSE THE BOARD ALREADY REVIEWED THIS IN JANUARY AND FEBRUARY OF LAST YEAR PRIOR TO THE SHUTDOWN.

WE HAD FEEDBACK AT THAT WORK SESSION THAT THERE WERE A COUPLE ADDITIONAL TWEAKS REQUESTED.

YOU CAN DISTINGUISH BETWEEN THE NEW CHANGES IN ORANGE.

ONE OF THE REQUESTS WAS THAT ANY CONCERNS COULD BE COMMUNICATED TO ANY PERSON IN THE EMPLOYEE SUPERVISORY CHAIN AND NOT NEARLY THE DIRECT SUPERVISOR.

THIS IS IN LINE WITH OUR COMMUNICATION PROTOCOL ON OUR WEBSITE.

AND THE OTHER CHANGE YOU WILL SEE IN ORANGE WHICH IS IN THE SECOND PARAGRAPH, ON PAGE 1 IS ADDING IN THE SUPERINTENDENT WORKS WITH REPRESENTATIVES OF ADVISORY COUNCILS FOR THIS WAS TO BRING OUR LANGUAGE IN LINE WITH SUPERINTENDENCE DIRECTIVE REGARDING TEACHER ADVISORY COUNCILS.

TO RECOGNIZE THE SUPERINTENDENT MEETS WITH NOT JUST EMPLOYEE ASSOCIATIONS, THE VARIOUS ADVISORY COUNCILS.

OKAY.

MOVING ON.

NEXT POLICY IS IN GBA.

THIS IS UNLAWFUL AND FACTURE, DISTRIBUTION, DISPENSING, POSSESSION OR USE OF THE CONTROLLED SUBSTANCE.

THIS POLICY COMES TO YOU AS PART OF OUR FIVE-YEAR REVIEW CYCLE.

IT IS ALSO BEFORE YOU TO UPDATE AMENDMENTS TO 41 USC 8103 AND 8104.

THE REVISIONS HAVE BEEN MADE TO ALIGN WITH THE CURRENT LANGUAGE IN THOSE STATUTES, INCLUDING THE DEFINITION OF CONTROLLED SUBSTANCE.

YOU WILL SEE IN THE FIRST PARAGRAPH WHERE ANABOLIC STEROIDS AND ALCOHOL HAVE BEEN TWEAKED TO RECOGNIZE THE FACT THAT THE LEGAL DEFINITION OF CONTROLLED SUBSTANCE DOES INCLUDE ANABOLIC STEROIDS.

ALCOHOL IS NOT CONSIDERED A CONTROLLED SUBSTANCE.

SO IT IS ADDRESSED SEPARATELY TO DISTINGUISH IT FROM THAT DEFINITION.

AND BECAUSE CONTROLLED SUBSTANCES ARE THE FOCUS OF THIS POLICY, PROHIBITED POSSESSION AND USE OF ALCOHOL ON SCHOOL PROPERTY IS GOVERNED BY VIRGINIA CODE 4.1 â€" 309.

IT IS ADDRESSED ANOTHER POLICIES.

KB G AND CLA.

MOVING ON TO POLICY GC D.A.. EFFECTIVE CRIMINAL CONVICTION OR FOUND IN COMPLAINT OF CHILD ABUSE OR NEGLECT.

THESE REVISIONS REFLECT AMENDMENT OF VIRGINIA CODE 22.1 â€" 296.1.

THE AMENDMENT PROHIBITS EACH SCHOOL BOARD FROM EMPLOYEE IN THE INDIVIDUAL WHO HAS BEEN CONVICTED OF A VIOLENT FELONY.

IN ANY CRIME INCLUDED IN THE DEFINITION OF A BARRIER CRIME IN THE CODE OF VIRGINIA, INCLUDING ANY OFFENSE INVOLVING THE SEXUAL MOLESTATION, PHYSICAL OR SEXUAL ABUSE OR RAPE OF A CHILD.

THE CHANGE IN THE LANGUAGE IN THE SECTION OF THE CODE DOES PROVIDE NARROW EXCEPTIONS THAT WOULD ALLOW THE BOARD TO HIRE AN INDIVIDUAL, ALLOW THE BOARD BUT NOT REQUIRE THE BOARD TO HIRE AN INDIVIDUAL CONVICTED OF A FELONY.

NOT ONE OF THE TYPES OF FELONIES I JUST LISTED.

WHEREAS IN THE PAST THE BOARD WAS PREVENTED FROM HIRING ANYONE CONVICTED OF A FELONY.

THAT CHANGE IS NOW A VIOLENT FELONY.

THERE ARE NARROW EXCEPTIONS AS I SAID TO THE SCHOOL BOARD HIRING AN EMPLOYEE WHO HAS BEEN CONVICTED OF A FELONY.

THERE ARE PARALLEL PROVISIONS FOR CONTRACTORS AND THEIR EMPLOYEES WHO HAVE DIRECT CONTACT TO STUDENTS.

[00:35:01]

AGAIN, THE LAW PREVIOUSLY PROVIDED ANY FELONY CONVICTION WAS A BAR TO EMPLOYMENT TO THE PUBLIC SCHOOLS.

NEXT POLICY IS GCL.

PROFESSIONAL STAFF DEVELOPMENT.

THIS REVISION REFLECTS ENACTMENT OF VIRGINIA CODE 22.1 â€" 298.6 REGARDING THE NEW REQUIREMENT FOR THE SCHOOL DIVISION TO PROVIDE MENTAL HEALTH AWARENESS TRAINING FOR EACH TEACHER AND OTHER PERSONNEL.

YOU WILL SEE THE REVISION ON THE BOTTOM OF PAGE 1 IN BLUE.

AGAIN, THIS REQUIRES THE BOARD TO PROVIDE THE TRAINING AND ALSO REQUIRES THE STAFF LISTED HERE TO ACTUALLY TAKE THE TRAINING.

AND MAYBE ONLINE TRAINING IN THIS TRAINING IS REQUIRED AS IT SAYS IN THE STATUTE, AT LEAST ONCE.

IT IS NOT REQUIRED ANNUALLY.

NEXT POLICY IS GC P.D.

LICENSED STAFF DISCIPLINE.

THIS REVISION REFLECTS AMENDMENT OF VIRGINIA CODE 22.1 â€" 307.

THIS REVISION HAS REMOVED THE DEFINITION OF INCOMPETENCY FOR THE PURPOSE OF ESTABLISHING GROUNDS FOR DISMISSAL OF PUBLIC SCHOOL TEACHERS, INCOMPETENCY DOES REMAIN A BASIS FOR DISMISSAL, BUT THE DEFINITION WAS STRICKEN FROM THE SECTION OF THE CODE.

AND THEREFORE THE DEFINITION WAS ALSO STRICKEN FROM THE POLICY.

POLICY GD Q IS NEXT.

THIS IS SCHOOL BUS DRIVERS.

THIS IS ANOTHER POLICY THE BOARD IS NOT SEEN FOR FIVE YEARS SO IT IS COMING TO US AS PART OF THE FIVE-YEAR REVIEW CYCLE.

IT HAS BEEN UPDATED TO ALIGN WITH THE SEVERAL SECTIONS OF THE CODE OF FEDERAL REGULATIONS.

CURRENT REQUIREMENTS, ESPECIALLY REGARDING ALCOHOL AND DRUG TESTING.

AND IF WE SCROLL THROUGH THE POLICY, WE SEE THERE ARE SOME UPDATES TO REFLECT THE PROPER DEFINITION OF CONTROLLED SUBSTANCES.

IT LISTS ALL THE DIFFERENT SITUATIONS.

WHERE AN WHEN.

SO IF THERE WAS A PREEMPLOYMENT ANNUAL REQUIREMENT FOR ALCOHOL AND CONTROLLED SUBSTANCE TESTING AND REPORTING, THEY ARE ALL SPELLED OUT HERE.

PREEMPLOYMENT QUERY IS REQUIRED FOR THE COMMERCIAL DRIVERS LICENSE, DRUG AND ALCOHOL CLEARINGHOUSE.

THERE ARE REQUIREMENTS AGAIN, AS I SAID, TO PERFORM AN ANNUAL QUERY OF THAT CLEARINGHOUSE.

AND ALSO REQUIRES, IF YOU LOOK AT THE BOTTOM OF PAGE 2, YOU WILL SEE SOME OF THE STRICKEN LANGUAGE WAS TITLED REQUIRED TESTING.

THAT SECTION COVERED IN THE ELIGIBILITY FOR EMPLOYMENT SECTION.

ON THE THIRD PAGE, THERE'S A LARGE SECTION TITLED MODIFICATION THAT RELATES TO 382.601.

THIS IS DISCUSSING THE EMPLOYER OBLIGATION TO PROMULGATE A POLICY ON THE MISUSE OF ALCOHOL AND CONTROLLED SUBSTANCES FOR EMPLOYEES OPERATING WITH A COMMERCIAL DRIVERS LICENSE AND THEN WE MOVE ON TO POLICY CLA.

REPORTING ACTS OF VIOLENCE AND SUBSTANCE ABUSE.

THIS REVISION REFLECTS AMENDMENT OF VIRGINIA CODE 22.1 â€" 279.3, SUBSECTION 1.

THAT ELIMINATE THE REQUIREMENT FOR THIS WILL BE FAMILIAR BECAUSE OF THE RECENT DISCUSSION OF OUR ACP IS AN ALEXANDRIA POLICE DEPARTMENT MOU.

AND I SHOULD HAVE MENTIONED WE ARE MOVING INTO THE TWO POLICIES RELATED TO LAW ENFORCEMENT AT THIS POINT.

THE REVISION TO THE SECTION OF THE CODE ELIMINATES THE REQUIREMENT FOR THE SCHOOL PRINCIPAL OR SUPERINTENDENT TO REPORT TO LOCAL LAW ENFORCEMENT CERTAIN ACTS WOULD CONSTITUTE MISDEMEANORS.

AND IT REQUIRES THAT WHEN THE PRINCIPAL REPORTS ANY ACT THAT MAY BE IN A CRIMINAL OFFENSE TO THE PARENTS OF A MINOR, THE PRINCIPAL MUST ALSO NOTIFY THE PARENTS WHETHER OR NOT THE INCIDENT HAS BEEN REPORTED TO LAW ENFORCEMENT.

[00:40:02]

SO THE MAIN CHANGE HERE IS THAT THE PRIOR REQUIREMENT MANDATORY REPORTING REQUIREMENT WAS TO REPORT ANY CRIMINAL OFFENSE TO LOCAL LAW ENFORCEMENT.

AND THIS HAS BEEN CHANGED TO ANY ACT WHICH MAY CONSTITUTE A FELONY.

IN THE DIFFERENT INCIDENTS OR ACTS THAT APPLY ARE SPELLED OUT IN THE SECTION OF THE CODE.

IF WE MOVE ON TO OUR FINAL POLICY FOR THIS EVENING, WHICH IS CAN A A J RELATIONS WITH LAW ENFORCEMENT AUTHORITIES, THERE ARE ALSO CHANGES IN HERE YOU WILL BE FAMILIAR WITH.

THE FIRST CHANGE IS THE SAME ONE WE JUST DISCUSSED, WHICH IS THE CHANGE FOR PRINCIPALS AND SUPERINTENDENTS INSTEAD OF BEING REQUIRED TO REPORT ACTS WHICH WOULD CONSTITUTE A CRIMINAL OFFENSE IT IS NOW ONLY A FELONY OFFENSE TO LAW ENFORCEMENT.

THEREFORE ELIMINATING REQUIRED REPORTING FOR MISDEMEANORS.

TO THE SAME CHANGE YOU WILL SEE IN THIS POLICY AND THE OTHER CHANGES ALL REFLECT AS WE DISCUSSED.

THE FACT THAT IF A SCHOOL VISION HASN'T AND WILL YOU WITH THE LOCAL LAW ENFORCEMENT AUTHORITY, THAT MUST BE REVIEWED EVERY TWO YEARS.

THAT IT MUST BE POSTED ON THE WEBSITE.

THAT THERE MUST BE PUBLIC INPUT DURING THAT REVIEW.

AND FINALLY, THE OTHER CHANGE REFLECTED HERE AS WELL, AND THIS IS IN THE MOU SECTION ON PAGE 2.

THERE IS ALSO RECOGNITION OF THE FACT THERE ARE NEW VIRGINIA BOARD EDUCATION REGULATIONS COMING OUT THAT WILL BE EFFECTIVE JANUARY 1 OF 2021, WHICH REQUIRE ANY EMAIL YOU TO ADDRESS SECLUSION AND RESTRAINT BY LAW ENFORCEMENT IN SCHOOL SETTINGS.

THAT WAS DISCUSSED THOROUGHLY AND INCLUDED IN OUR VISIONS, BUT WE ARE REQUIRED IN POLICY TO RECOGNIZE THAT THAT IS A REQUIRED ELEMENT OF ANY MOU.

AND NOW I AM READY FOR QUESTIONS.

>> OKAY.

I THINK IT IS PROBABLY BEST BECAUSE OF THE SHARING THE SCREEN IF WE GO ONE BY ONE TO SEE IF THERE ARE QUESTIONS SO WE DON'T HAVE TO HAVE SUSAN GO BACK AND FORTH.

SO IS THERE ANY â€" SORRY.

EVERYONE HAS QUESTIONS ALREADY.

ARE THERE TELEWORK QUESTIONS IS WHAT I AM LOOKING FOR RIGHT NOW.

! YES, THIS IS HEATHER.

>>CINDY ANDERSON: GO AHEAD.

>>HEATHER THORNTON: THANK YOU SO MUCH.

WE ALWAYS APPRECIATE YOU KEEPING US ON OUR POLICIES.

AQUEOUS QUICK QUESTION REGARDING THE TELEWORK.

I NOTICED FOR THE SECTION ON THE INDIVIDUAL TO LOWER, AND SPECIFICALLY SAYS EMPLOYEES WILL NOT BE REIMBURSED FOR WORK-RELATED EXPENSES.

BUT IT DOES NOT HAVE A SIMILAR WORDING OR PROVISION FOR THE MASS TELEWORK SECTION.

I WAS WONDERING IF THAT IS BECAUSE WE ACTUALLY DO, IN LIGHT OF COVID IN THE PANDEMIC CRISIS, WE ACTUALLY REIMBURSING EMPLOYEES FOR SOME WORK-RELATED EXPENSES SUCH AS HAVING TO PURCHASE HIGHER INTERNET OR ANY OTHER EQUIPMENT CHALLENGES? DO WE DO THAT CURRENTLY AND IS THAT WHY WE DID NOT INCLUDE THAT IN THE POLICY? THIS MIGHT BE FOR DOCTOR HUTCHINGS, ACTUALLY.

I DON'T KNOW.

WHOEVER CAN ANSWER THAT.

>> I APPRECIATE THE QUESTION.

I WILL LOOK THROUGH THE LANGUAGE OF THE REGULATION.

IF WE OMITTED THAT, WE WILL ADD IT IN.

IT IS COVERED IN THE TELEWORK AGREEMENT, WHICH IS ATTACHMENT TO.

WHICH WILL APPLY TO EVERY EMPLOYEE WHO IS TELEWORKING.

WHETHER IT IS THROUGH A MASS TELEWORK EVENT OR AN INDIVIDUAL REQUEST.

IT IS INCLUDED IN THE AGREEMENT THAT EQUIPMENT IS NOT PROVIDED OR IT IS NOT REIMBURSED.

SUCH EXPENSES.

BUT IF IT NEEDS TO BE IN THE ACTUAL REGULATION, I WILL DOUBLE CHECK AND WE CAN ADD IT THERE AS WELL.

BUT IT IS CURRENTLY IN THAT AGREEMENT.

>>HEATHER THORNTON: OKAY.

THANK YOU.

>>CINDY ANDERSON: OKAY.

MS. GENTRY, DO YOU HAVE ONE ON THIS? P8 NO, I DO NOT.

>>CINDY ANDERSON: OKAY.

MR. SUAREZ, TELEWORK OR NO?

>>CHRISTOPHER SUAREZ : NO.

>>CINDY ANDERSON: OKAY DOCTOR RIEF.

>>MICHELLE RIEF : YES, A QUESTION IS ABOUT TELEWORK.

IN ONE OF FOLLOW-UP TO MISS GORDON'S QUESTION, WHICH WAS A SIMILAR QUESTION I HAD.

I HAVE SEEN OTHER DIVISIONS HAD BEEN REIMBURSING STOCK MEMBERS FOR INTERNET IN

[00:45:05]

THEIR HOME.

WAS CURIOUS IF WE HAVE HAD TO PROVIDE INTERNET SERVICES FOR ANY OF OUR STAFF MEMBERS WERE ASSIST THEM IN GETTING INTERNET SERVICES OR CONSIDERED COVERING THAT EXPENSE? I HAVE BEEN CONCERNED ABOUT THE ADDITIONAL WORK-RELATED EXPENSES THAT EMPLOYEES MIGHT BE HAVING TO PICK UP DURING THIS TIME.

I DON'T KNOW WHAT KINDS OF OTHER CIRCUMSTANCES WE MIGHT HAVE STAFF MEMBERS WITH A SPOUSE WHO HAS BEEN LAID OFF FOR THAT KIND OF THING.

SO I WAS CURIOUS ABOUT THAT.

AND THEN I HAD A COUPLE OF OTHER QUESTIONS ABOUT THIS POLICY.

ON NUMBER THREE, ON PAGE 2 IT SAYS EMPLOYEES MUST KEEP TRACK OF HOW THEIR TIME IS SPENT.

WAS WONDERING IF THERE WAS SOME KIND A STANDARD WAY THEY ARE EXPECTED TO DO THAT DURING TELEWORK.

MAYBE IT SOUNDS LIKE YOU ALL USE THE TIME CLOCK SYSTEM REMOTELY OR SOMETHING.

BUT I WAS CURIOUS TO UNDERSTAND MORE ABOUT THAT.

AND ALSO WHY THE TELEWORK POLICY IS NOT GRIEVE A BOWL.

I THINK THAT COMES NEAR THE END.

IF YOU COULD TALK ABOUT THOSE THREE ASPECTS OF THIS POLICY, THAT WOULD BE GREAT.

>> I WILL TALK ABOUT THE FIRST TO AND THEN SHE CAN TALK ABOUT THE LAST COMMENT IN REGARDS TO THE TELEWORK.

SO FIRST I WANT TO SAY WE DO PROVIDE SOME OF OUR STAFF MEMBERS WITH WIRELESS INTERNET, SUCH AS THE SAME THINGS WE PROVIDE TO THE FAMILIES.

SOME OF OUR STAFF MEMBERS PREFER, THEY ALREADY HAVE INTERNET SERVICE IN THEIR HOMES, SOMETHING THEY CURRENTLY USE AND THAT EVERYTHING.

SO WE DON'T PROVIDE IT TO EVERY STAFF MEMBER.

BUT FOR STAFF MEMBERS WHO NEED IT, ABSOLUTELY.

BECAUSE IT IS FOR NOW, WHEN WE ARE IN THIS VIRTUAL WORLD, IT IS A NECESSITY IN ORDER TO DO YOUR JOB.

AND SO WE DO PROVIDE IT FOR FAMILIES OR FOR STAFF MEMBERS WHO DO NOT HAVE THEIR INTERNET SERVICE.

WAS A SECOND PART TO YOUR QUESTION?

>>MICHELLE RIEF : IT WAS HOW EMPLOYEES, AND SAYS THEY HAVE TO TRACK.

>> THEIR TIME.

YES.

SO RIGHT NOW YOU AND DOCTOR WILKINS CAN ELABORATE ON THIS, BUT YOU CAN STILL DO YOUR TRACKING ONLINE THROUGH OUR COMPUTER OR ONLINE SERVICE WITH SOME OF THE TRACKING.

YOU CAN ALSO EMAIL.

BUT DOCTOR WILKINS, IF YOU CAN TALK TO OUR TIME CLOCK PLUS AS WELL AS WE ARE TO BE TRANSITIONING INTO AN UPGRADED TIME CLOCK AT SOME POINT TOO.

BUT DOCTOR WILKINS.

>> THAT IS CORRECT.

SO IN FEBRUARY OR SO WE WILL BE TRANSITIONING FROM TIME CLOCK PLUS TO ANOTHER SOFTWARE, WHICH WOULD ALLOW US TO DO REMOTE TIME AND ATTENDANCE.

BUT RIGHT NOW ESSENTIALLY THOSE FOLKS WHO ARE ON CONTRACT ARE STILL BEING PAID PER CONTRACT.

THERE IS NO SPECIFIC HOURLY TRACKING.

EXCEPT FOR THE FOLKS WHO ARE COMING IN ON SITE AND CLOCK IN AS PER NORMAL.

SO THAT IS HOW WE DO THAT.

AND WE ALSO HAVE A PAPER FORM AVAILABLE IF WE CAN'T DO IT ONLINE.

>> THANK YOU.

I KNOW YOU'RE GOING TO RESPOND TO THE FINAL QUESTION.

>> SURE.

JUST EXPAND ON THE SECOND POINT, ANOTHER PROVISION THAT YOU MENTIONED ON PAGE 2 ABOUT EMPLOYEES KEEPING TRACK OF THE WORK PERFORMED IN MEETING AGREED-UPON DEADLINES.

I KNOW THE THINKING BEHIND THAT LANGUAGE WAS TO SPEAK TO THE FACT THAT WHILE TELEWORKING EMPLOYEES AND THEIR SUPERVISORS NEED TO STAY IN TOUCH, WE HAVE AN AGREED-UPON REGULAR CHECK IN SCHEDULE.

HAVE THE SUPERVISOR BE ABREAST OF ALL THE TASKS THE EMPLOYEES ARE WORKING ON.

IT JUST SPEAKS TO OPEN COMMUNICATION I THINK IS THE POINT OF THAT CLAUSE.

CONSTANT COMMUNICATION SINCE WE ARE PHYSICALLY SEPARATED AS TO WHAT THE EXPECTATIONS ARE, WHAT THE TIMELINES AND DEADLINES ARE, WHAT EVERYONE IS WORKING ON IN THE REGULAR.

AS TO THE GRIEVE ABILITY, MY UNDERSTANDING IS WE HAVE FOR LICENSE STAFF AND SUPPORT

[00:50:01]

STAFF, WE HAVE GRIEVANCE POLICIES AND GRIEVANCE PROCEDURES THAT ADHERE TO STATE REGULATIONS AND MY UNDERSTANDING IS THERE ARE CERTAIN CAUSES THAT ARE AGREEABLE AND CERTAIN THINGS THAT ARE NOT PROVABLE.

AND THAT OF THE TERM DETERMINATION MADE BY THE BOARD AND THE BOARD ATTORNEY THAT IS SPELLED OUT.

I'M HAPPY TO DISCUSS THIS WITH COUNSEL AND HAVE A NOTE SENT TO THE BOARD AND EXPLAINING WHY THIS ONE IS NOT GRIEVE A BOWL.

BUT I KNOW THERE IS DEFINITELY A LEGAL DETERMINATION THAT THERE ARE CERTAIN THINGS THAT ARE MARKED.

>> THANK YOU.

I GUESS ONE OF MY CONCERNS WAS IT SAID EMPLOYEES HAD TO RECORD THE WORK THEY WERE PERFORMING.

AND I WAS CONCERNED IF THAT WASN'T CLEARLY EXPLAINED TO THEM THAT ASK PATIENT EXPECTATION AND LATER COULD THEY BE PENALIZED FOR THAT AND NOT HAVE THE OPPORTUNITY TO GRIEVE THAT SITUATION.

I DID HAVE ONE OTHER QUESTIONS ABOUT THE TELEWORK POLICY.

THAT IS OUR WE GOING TO STILL HAVE SNOW DAYS OR NOT.

I KNOW THIS IS A VERY HOT TOPIC PARIS THIS MAY BE AN OPPORTUNITY TO WEIGH IN ON THE SNOW DAY DEBATE.

>> THE SNOW DAYS WON'T BE STUDENT SNOW DAYS.

BECAUSE STUDENTS ARE CURRENTLY NOT IN SCHOOL BUILDINGS.

HOWEVER, WE DO HAVE SOME STAFF MEMBERS WHO REPORT AND TO OUR BUILDINGS BECAUSE THEY ARE ESSENTIAL STAFF.

WE WILL STILL HAVE TO CALL SCHOOL DIVISION SNOW DAYS FOR PEOPLE REPORTING INTO OUR BUILDINGS.

AT SOME POINT OUR ROADS ARE GOING TO BE FULL OF SNOW AND ICE AND IT MAY NOT BE SAFE FOR THEM TO DRIVE TO WORK.

IF THERE IS A SNOW DAY, THE SNOW DAYS WILL BE FOR ESSENTIAL PERSONNEL REPORTING INTO OUR SCHOOLS DURING THIS VIRTUAL WORLD RIGHT NOW.

AND IS A GOOD QUESTION.

WE JUST TALKED ABOUT IT LAST WEEK.

>> INQUIRING KIDS WANT TO GO.

I KNOW WE TALKED ABOUT WE WERE SHARING THESE POLICIES WITH THE EAA.

AND THEY MADE THEIR COMMENTS ALREADY?

>> I RECEIVED NO COMMENTS BACK.

I DON'T KNOW IF DOCTOR WILKINS HAS.

>> WE RECEIVED NO COMMENTS BUT WE DID SHARE THIS WITH EAA.

>> I ALWAYS FIND THAT HELPFUL.

BECAUSE THEY WE KNOW THERE WERE EYES ON FROM THE EAA.

OKAY, SO THINK OF THERE ARE NO OTHER QUESTIONS ON TELEWORK, WE WILL MOVE ON TO THE NEXT ONE.

AND SO NOW IF WE HAVE ONES ABOUT GBD LET ME KNOW WHAT I SEE THERE ARE THREE PEOPLE WITH THEIR HANDS RAISED.

I JUST THOUGHT BOPPING AROUND THE POLICIES WOULD BE DIFFICULT.

MAY BE NONE FOR THAT ONE.

SO WE WILL GO ON.

AND LG BEA.

JUST TALK IF YOU HAVE ONE.

I DON'T HEAR OR SEE ANYBODY THAT IS NEW PUTTING HER HAND UP SO LET'S KEEP GOING.

ALL RIGHT GCDA.

OKAY.

WE WILL KEEP GOING.

GCL.

LET'S KEEP GOING.

GCPD.

THAT DOESN'T SEEM TO BE THE ONES EITHER.

OKAY.

GDQ.

OKAY, LET'S KEEP GOING.

CLA.

OKAY.

KANJ.

IS THAT YOURS, MS. GENTRY.

OKAY.

>>RAMEE GENTRY : MY QUESTION ON THIS IS IN TERMS OF, I AM SEEING A LANGUAGE THAT SAYS LAW ENFORCEMENT OFFICER WILL BE RESPONSIBLE TO VERIFY THAT THE STUDENT HAS HAD CONTACT WITH THE PARENT, GUARDIAN OR LEGAL CUSTODIAN.

SO ONE OF THE THINGS I THINK HAS BEEN HELPFUL FOR EVERYONE FOLLOWING THE MOU

[00:55:03]

PROCESS TO UNDERSTAND IS THAT WHILE THEY ARE IN THE BUILDING, THEY ARE NOT A C.P.S.

EMPLOYEES.

AND SO I GUESS I'M JUST WONDERING IF YOU CAN WALK THROUGH, IS IT THE MOU â€" I GUESS I AM CURIOUS AS TO HOW WE CAN MONITOR AND ENFORCE THIS PARTICULAR THING IN ENSURING EVEN THOUGH THEY ARE NOT OUR EMPLOYEES, BUT ENSURING THAT IN FACT THEY ARE FOLLOWING THE LANGUAGE IN THIS POLICY AS TO NOTIFYING PARENTS.

AND THAT IT IS BEING DONE.

SO IT WAS MORE, NOT SO MUCH OF A REQUEST TO CHANGE LANGUAGE BUT IF SOMEONE COULD EXPLAIN TO ME HOW THAT WORKS.

>> SURE.

THANK YOU FOR THE QUESTION.

THE LANGUAGE IS PULLED FROM OUR REVISED AND RECENTLY APPROVED MOU.

AND SO I WOULD ASK MR. GERALD, WHO IS OUR COORDINATOR OF SECURITY EMERGENCY â€" SECURITY EMERGENCY OPERATIONS, IF HE COULD PLEASE ADDRESSED THAT.

HE MIGHT WANT TO SPEAK TO THAT.

>> SURE.

YES.

SO THAT IS A GREAT QUESTION.

BUT IT IS SPECIFIC IN WHAT HE CALLS OUT.

THAT DURING THIS ENTIRE INTERVIEW, IT SHOULD RATHER HAVE SOMEONE THERE, A PRINCIPAL OR DESIGNEE PRESENT THROUGHOUT THE ENTIRE INTERVIEW PROCESS.

THAT WITHIN ITSELF WAS A FAILSAFE THAT AS AN EMPLOYEE THAT WE HAVE A DUTY TO BASICALLY INFORM THAT PARENT OR GUARDIAN OR WHOEVER ABOUT WHAT IS HAPPENING IN REGARDS WITH THEIR CHILD.

AND SO OBVIOUSLY IT IS THERE FOR A REASON AND THAT'S WHAT IT IS.

>> ALSO, I THINK A PART OF THE STATEMENT INCLUDED THERE WAS TO ENSURE THAT IF THERE WAS EVER A POLICE OFFICER QUESTIONING A STUDENT, THAT THEY DON'T MAKE THE ASSUMPTION A PARENT HAS BEEN CONTACTED.

SO IT IS JUST ANOTHER CHECKS AND BALANCES THAT CAN OCCUR TO PREVENT A STUDENT FROM EVER SPEAKING TO AN OFFICER WITHOUT THEIR PARENTS KNOWING.

AND SO WE ALREADY HAVE THE SCHOOL MAKING SOME FORM OF CONTACT, THE POLICE OFFICER ENSURING THERE WAS SOME FORM OF CONTACT AND IT IS ANOTHER CHECKS AND BALANCES.

THAT WAS SOME OF THE REASONING BEHIND PUTTING IT INTO THE MOU.

TO PREVENT IT FROM HAPPENING AT ALL.

>> MAY I, ALSO, DOCTOR HUTCHINGS?

>> YES, PLEASE.

>> AND ALSO PART OF MAKING SURE THIS HAPPENS, MS. GENTRY.

IN THE NAME MOU IS A HEAVY EMPHASIS ON EDUCATION AND TRAINING OF THE SROS, AS WELL AS THE SCHOOL STAFF ON THIS REQUIREMENT.

THERE IS ALSO A NEW REPORTING REQUIREMENT IN THE MOU.

IF YOU RECALL.

THAT REQUIRES THAT TO BE DOCUMENTED.

AND THEN THE THIRD CHECK WE ALSO HAVE AS WE HAVE THE QUARTERLY PERFORMANCE REVIEW, WHICH WILL LOOK AT SUCH CASES IS ANOTHER MEANS TO MAKE SURE PARENTAL NOTIFICATION IS TAKING PLACE AT ALL TIMES.

THANK YOU.

>> THANK YOU EVERYONE.

>> MADAM CHAIR?

>>CINDY ANDERSON: YES, MS. GREENE, IS A QUESTION ABOUT THIS?

>>JACINTA GREENE: NO, IT IS NOT.

BUT I THINK WE PASSED THE ONE I WANTED TO TALK ABOUT.

I'M NOT SURE WITH THE CALLING OUT OF LETTERS.

BUT IT WAS THE ONE ABOUT THE HIRING OF FELONS.

>>CINDY ANDERSON: OKAY.

WE WILL GO BACK THEN.

I GUESS IS THERE ANYBODY ELSE FOR THE LAW ENFORCEMENT ONE? OKAY.

SO MAYBE WE CAN GO BACK TO THE HIRING FELONS ONE.

>> THAT IS POLICY GCDA.

>>JACINTA GREENE: THANK YOU AND I'M SORRY.

>>CINDY ANDERSON: NO, NO.

I SHOULD PROBABLY HAVE â€" IT WAS GOING BY QUICKLY.

>>JACINTA GREENE: NO WORRIES.

MS. ABBRUZZESE , I WANTED TO SAY WHY THIS IS NOT HAPPENING TO YOU AT THE 10:30 P.M.

OUR AS WE USED TO HAVE YOU.

IT ALWAYS FELT AT 10:30 P.M.

WHEN WE MET IN PERSON.

SO I KNOW THIS IS A LOT BETTER FOR YOU.

AND SO MY QUESTION IS, AND IF YOU COULD TALK A LITTLE BIT MORE TO â€" HE SAID THIS POLICY WORKS IN PARALLEL WITH OUR CONTRACTORS AS FAR AS HIRING FELONS TO WORK IN OUR SCHOOLS.

I WANT TO KNOW HOW IS THAT ENFORCED.

AND DO WE FOLLOW-UP UPON THAT IN THE HIRING OF FELONS WITH OUR CONTRACTORS IN THE

[01:00:07]

SCHOOLS?

>> THANK YOU FOR THE QUESTION.

THAT IS A GREAT QUESTION.

I THINK I SHOULD LOCK THAT DOCTOR WILKINS HANDLED THE SPECIFICS OF HOW THAT IS IMPLEMENTED.

>> THANK YOU.

SO WAS JUST SAY,: A CONSTRUCTION CONTRACT.

THERE IS A REQUIREMENT FOR THAT PARTICULAR COMPANY TO ENSURE IT CONDUCTS THE CHECKS TO MAKE SURE ITS WORKERS ARE AUTHORIZED IF YOU WILL, OR APPROVED TO BE AROUND CHILDREN.

IN PARTICULAR WE TO WORK IN AND AROUND A SCHOOL SITE.

AND SO THAT RESPONSIBILITY TO MAKE SURE THAT ACTUALLY HAPPENS FALLS ONTO THAT CONTRACTOR AND SELF.

WITH RESPECT TO HOW IT IS ENFORCED, WE WILL INR PROCUREMENT OFFICE TO MAKE SURE THE CONTRACTOR KNOWS OF THE REQUIREMENT AND ADHERES TO RESPECTIVE REQUIREMENT.

SHOULD THEY BE FOUND THEN WE WOULD TAKE THE APPROPRIATE ADMINISTRATIVE ACTION.

THANK YOU.

>>JACINTA GREENE: THAT HAPPENS IN THE PROCUREMENT PROCESS?

>> YES.

BECAUSE IN THE CONTRACTUAL PROCESS, WE CANNOT HIRE SOMEONE WHO CANNOT WORK ON SITE.

WORK IN A SCHOOL SETTING.

AND SO WITHIN THE CONTRACT LANGUAGE, WE REQUIRE THAT THE CONTRACTOR MAKE SURE THAT THEY HIRE SOMEONE WHO MEETS THOSE PARTICULAR REQUIREMENTS.

DOES THAT MAKE SENSE?

>>JACINTA GREENE: YES, IT DOES.

THANK YOU.

>>CINDY ANDERSON: THANK YOU MS. GREENE.

I SHOULD POINT OUT WHEN WE ARE DISCUSSING CONTRACTORS, THE PROVISION AND THE LOT RELATED TO CONTRACTORS AND THEIR EMPLOYEES SPECIFICALLY PROHIBITS EMPLOYEES WHO WOULD HAVE DIRECT CONTACT WITH STUDENTS ON SCHOOL PROPERTY, DURING SCHOOL HOURS OR DURING SCHOOL SPONSORED ACTIVITIES.

>>JACINTA GREENE: GREAT.

THANK YOU MS. ABBRUZZESE .

>>CINDY ANDERSON: OKAY.

SO NOW LET'S GO ON TO â€" IS THERE JUST ONE LEFT? IS THIS THE ONE.

>> MY QUESTION WAS ON THE VERY BOTTOM OF THE VERY LAST POLICY.

>>CINDY ANDERSON: OKAY.

>> I GUESS NOT THAT BOTTOM.

THE BOTTOM OF THE SUBSTANTIVE TEXT.

>>CINDY ANDERSON: IT IS HARD WITH THE SHARING THE SCREEN AND YOU CAN SEE LESS OF IT.

I HAD IT GOING ON MY SCREEN SEPARATELY TOO.

DOWN A LITTLE BIT MORE.

>> ARE YOU REFERRING TO SECTION 5?

>> YUP.

YES.

SO MY ONLY QUESTION â€" IT GOES BACK TO THE DISCUSSION WE HAD LAST TIME AND WITH THE PURPOSE OF THE REVIEW IS.

WE OBVIOUSLY HAD A VERY GOOD AND DEMOCRATIC PROCESS IN AMENDING THE AGREEMENT THIS YEAR, BUT WE OBVIOUSLY HAD A DIVIDED VOTE ON THAT ISSUE OR SOME DIDN'T WANT TO EVEN CONTINUE WITH THE MOU.

AND SO I THINK IT WOULD BE PRUDENT TO MAKE CLEAR THAT IT IS NOT A FOREGONE CONCLUSION.

EVERY ITERATION OF THE REVIEW.

THAT IT WOULD BE AMENDED OR AFFIRMED EVERY SINGLE TIME THAT THE REVIEW IS REALLY TO CONSIDER EACH TIME USING DATA, WHETHER WE AFFIRM, AMEND OR TERMINATE OR RECENT.

I DON'T KNOW WHICH LANGUAGE WOULD BE MORE APPROPRIATE THE MOU.

BUT I DON'T WANT THE COMMUNITY TO GET THE IMPRESSION FROM THIS THAT IT IS AUTOMATICALLY GOING TO BE AMENDED OR AFFIRMED WITH EACH REVIEW.

>> THANK YOU FOR THAT POINT.

I WILL MAKE SURE TO ADD THAT IN THE REVISION THAT GOES TO THE BOARD FOR ACTION.

>> SO IT IS WHETHER WE DO IT AS WELL AS DOING IT.

OKAY.

THAT IS A GREAT POINT.

ALL RIGHT.

ANYBODY ELSE FOR ONES THAT WE MAY BE WENT TO BUY AND I CALLED OUT THE LETTERS AND IT WAS HARD TO MATCH UP WITH THE PRINT? I DON'T SEE ANY.

SO I AGREE WITH MS. GREENE, IT IS MUCH BETTER TO BE DOING THIS AT NOT 10:30 P.M.

[01:05:09]

AT NIGHT WHEN WE ARE ALL QUITE TIRED.

IT IS REFRESHING, ISN'T IT? IT FEELS LIKE â€" IT IS NOT PAINFUL.

AT ALL.

ALL RIGHT.

SUITE LOOK FORWARD TO THE NEXT CROP OF 10.

AND THESE WILL BE ON OUR BOARD MEETING FOR NEXT THURSDAY, RIGHT?

>> THESE WILL BE UP FOR CONSENT AND IN THE NEXT BATCH OF 10 TO REVIEW FOR INFORMATION WILL BE JANUARY 14.

>>CINDY ANDERSON: OKAY.

GREAT.

NOW I THINK THAT WE ARE â€" IT IS FUNNY, WITH THE SPREADSHEETS FROM AGENDA SETTING, I GET ALL THESE TOPICS IN MY HEAD WE TALK ABOUT THEM AND I FORGET EXACTLY WHICH DAY THEY ARE HAPPENING.

AND SO NOW
